1.Basic Policy for Protection of Personal Information

Nippon Building Fund Management, Ltd. ("NBFM") will comply with the Law Concerning the Protection of Personal Information ("Personal Information Protection Law") as well as other related laws, regulations and guidelines issued by the relevant administrative agencies for the treatment of personal information and will endeavor to appropriately handle, manage and protect such information.

Acquisition of Personal Information

NBFM will acquire personal information through legal and fair means to the extent necessary to achieve the purposes of use defined in Paragraph 3. "Purposes of Use of Personal Information" below (the "Purposes of Use").

When acquiring personal information, NBFM will disclose in advance the Purposes of Use on its website etc. or communicate or disclose the same promptly after acquisition to any individual whose personal information was so acquired. If personal information is acquired directly from an individual in written form, the Purposes of Use shall be expressly disclosed in advance; provided, however, that in the event that the Purposes of Use are considered to be obvious in light of the circumstances of such acquisition or as otherwise permitted by law, such notification, disclosure or indication may be omitted.

Personal information acquired by NBFM includes, in addition to personal information concerning investors or prospective investors in investment shares of NipponBuilding Fund, Inc. ("NBF"), personal information of tenants and other customers of managed assets of NBF.

3.Purposes of Use of Personal Information

Personal information will be used by NBFM in order to perform asset management services entrusted by NBF and other ancillary or related duties in accordance with the Financial Instruments and Exchange Law and the Law Concerning Investment Trusts and Investment Corporations (the "Investment Trust Laws"). Such purposes include the following. NBFM will, except as provided to the contrary by laws and regulations, not use any personal information for any purpose beyond the scope of the following Purposes of Use.

  • exercise by investors of their rights and the performance by NBF of its obligations in connection with which NBF entrusts NBFM with asset management (acquisition, management, sale of, or funding for assets etc.) under the Investment Trust Laws and other related laws and regulations;
  • asset management conducted by NBFM as entrusted by NBF as well as research, analysis, and review in connection with such asset management;
  • confirmation of and response to inquiries etc.;
  • proper and smooth performance of general administrative affairs and related services conducted by NBFM; and
  • disclosure and provision of personal information to third parties to the extent necessary to achieve the abovestated Purposes of Use.

Disclosure or Provision of Personal Information to Third Parties

NBFM will not disclose or provide any personal information acquired by it to any third party except where:

  • an individual whose personal information is to be disclosed or provided has consented to such disclosure or provision;
  • such disclosure or provision is in accordance with laws and regulations;
  • such disclosure or provision is required to prevent death or injury to persons or damage to property but it would be difficult to obtain such individual's consent thereto;
  • such disclosure or provision is required to improve public health or promote healthy child-rearing but it would be difficult to obtain such individual's consent thereto;
  • such disclosure or provision is required in order to cooperate with national or local governmental authorities or with any person on their behalf in performing administrative affairs stipulated by laws and regulations, but obtaining such individual's consent thereto could hinder the performance of such affairs;
  • to the extent necessary for achievement of the Purposes of Use, NBFM entrusts in whole or in part handling of personal information to contractors who are under NBFM's proper control and supervision; or
  • such disclosure or provision is otherwise permitted by the Personal Information Protection Law.

Management of Personal Information

NBFM will endeavor to maintain the accuracy and currency of personal information. NBFM will also implement necessary and adequate security measures to prevent any leakage, loss, or tampering etc. of personal information and otherwise securely maintain the same. In addition, NBFM will bind its contractors to whom personal information is to be disclosed or provided to strict obligations concerning safety measures to ensure safe management of personal information and supervise their implementation of such safety measures.

Inquiries Concerning Personal Information etc.

Any questions or complaints in connection with personal information, or requests for disclosure, correction, addition or deletion, or cessation of use, or elimination or cessation of provision to third parties, or notice of purpose of use etc. in connection with retained personal data, should be directed as follows. Information regarding required procedures etc. will be provided. Consultations or complaints etc. concerning NBFM's handling of personal information may also be directed as follows:

7.Change of Privacy Policy

This privacy policy is subject to change for the purpose of improving the system for protecting personal information, or due to amendment of laws and regulations etc. Any notice of any material change will be provided in an easily comprehensible manner such as by posting on our website.
